Terms of Service

Last updated: August 9, 2026

Welcome to Daygo Vs Everybody. These Terms of Service (“Terms”) govern your access to and use of daygovseverybody.store (the “Site”) and your purchase of products from Daygo Vs Everybody (“we,” “us,” or “our”). By accessing the Site, placing an order, or using our services, you agree to these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to make a purchase. If you are under that age, you may use the Site only with the involvement and permission of a parent or legal guardian.

Products and Availability

We sell clothing, accessories, and related merchandise. Many items are released in limited drops and may not be restocked. Product availability is not guaranteed, and we may limit quantities, discontinue products, or cancel orders when necessary.

We try to display product colors, images, descriptions, sizing, and other details accurately. Actual colors and appearance may vary by screen or device. Measurements and fit information are estimates unless otherwise stated.

Orders and Payment

By placing an order, you offer to purchase the products in your cart under these Terms. An order confirmation does not mean we have accepted your order. We may decline or cancel an order because of inventory errors, suspected fraud, payment issues, pricing errors, shipping restrictions, or other legitimate reasons.

You agree to provide current, complete, and accurate billing, shipping, and payment information. You authorize us and our payment processors to charge the total shown at checkout, including applicable taxes, shipping, and other disclosed fees.

If we cancel an order after payment, we will refund the amount charged for the canceled item or order to the original payment method.

Pricing and Promotions

Prices are shown in U.S. dollars unless stated otherwise. Prices, promotions, discount codes, and product availability may change without notice. Promotional offers may have additional terms and may not be combined unless expressly allowed. We may correct pricing or description errors and cancel affected orders.

Shipping and Delivery

Shipping estimates are not guarantees. Delivery times may be affected by carrier delays, weather, customs, incorrect address information, high order volume, or other events outside our reasonable control.

You are responsible for providing an accurate and complete delivery address. Any risk of loss transfers to you when the order is delivered to the address provided at checkout, except where applicable law requires otherwise.

International customers are responsible for customs duties, import taxes, brokerage fees, and other charges imposed by the destination country unless checkout states otherwise.

Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by the return or refund policy posted on the Site at the time of purchase. Please review that policy before ordering. Items marked final sale, limited release, customized, worn, washed, damaged after delivery, or missing original tags or packaging may be ineligible, subject to applicable law.

Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.

SMS and Marketing Messages

If you opt in to receive text messages, you agree to receive promotional messages, product announcements, restock alerts, special offers, and cart reminders from Daygo Vs Everybody. Message frequency may vary. Message and data rates may apply. Consent is not a condition of purchase.

You may opt out at any time by replying STOP. For help, reply HELP or contact us through the Site. Mobile information and text-message consent will be handled as described in our Privacy Policy.

Accounts and Site Security

If you create an account, you are responsible for keeping your login credentials confidential and for activity under your account. Notify us promptly if you believe your account has been accessed without permission.

You may not misuse the Site, attempt to gain unauthorized access, interfere with its operation, introduce malicious code, scrape or copy content through automated means without permission, commit fraud, impersonate another person, or use the Site for unlawful purposes.

Intellectual Property

The Site and its content—including the Daygo Vs Everybody name, logos, graphics, photographs, product designs, text, videos, and layout—are owned by or licensed to Daygo Vs Everybody and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable license to use the Site for personal, noncommercial shopping purposes. No other rights are granted.

Third-Party Services and Links

The Site may use or link to third-party services, including payment processors, shipping carriers, social platforms, and embedded content. We do not control third-party websites or services and are not responsible for their content, availability, security, or practices. Your use of them may be governed by separate terms.

Privacy

Our collection and use of personal information are described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

Disclaimers

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free. We disclaim implied warranties to the extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Daygo Vs Everybody and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from the Site, products, or these Terms.

To the fullest extent permitted by law, our total liability for a claim related to a product will not exceed the amount you paid for that product, and our total liability for any other claim will not exceed $100. These limits do not apply where prohibited by law or to liability that cannot legally be limited.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Daygo Vs Everybody and its owners, employees, contractors, and affiliates from claims, losses, liabilities, and expenses arising from your unlawful use of the Site, your violation of these Terms, or your infringement of another person’s rights.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute not required by applicable law to be heard elsewhere will be brought in the state or federal courts serving San Diego County, California, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Changes apply prospectively unless applicable law permits otherwise. Your continued use of the Site after an update means you accept the revised Terms.

Severability and Waiver

If any part of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.
